DMCA Copyright Policy

Band Live respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, Band Live will respond expeditiously to claims of copyright infringement committed using the Service that are reported to our designated Copyright Agent, identified below.

1. Reporting Alleged Copyright Infringement

If you are a copyright owner (or an agent authorized to act on behalf of one) and you believe in good faith that content available through the Service infringes your copyright, please submit a written notice to our designated Copyright Agent containing all of the following elements required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (for example, the URL where the material appears, or, if the material is not accessible via a public URL, enough detail about the band and item that we can locate it in our system).
  4. Information reasonably sufficient to permit us to contact you: address, telephone number, and, if available, an email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Please do not submit a takedown notice unless you are sure of the facts.

3. Our Response

Upon receipt of a proper DMCA notice, Band Live will:

We generally aim to act on complete and properly-formed notices within five (5) business days of receipt.

4. Counter-Notification

If you are a user of the Service and content you posted was removed following a DMCA notice, you may submit a counter-notification. To be effective, a counter-notification must be a written communication to our Copyright Agent that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which the Service may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of that person.

Upon receipt of a valid counter-notification, we will forward it to the original notifier. If they do not notify us within ten (10) business days that they have filed a legal action to keep the material down, we may restore the removed material.

5. Repeat-Infringer Policy

Band Live will terminate, in appropriate circumstances and at our sole discretion, the accounts of users who are determined to be repeat infringers of copyright. Determinations are made based on the number and nature of DMCA notices received, patterns of user behavior, and other factors we consider relevant.

6. Modifications

We may update this DMCA Policy from time to time. The "Last updated" date above indicates when this page was last revised. Continued use of the Service after changes are posted constitutes acceptance of the revised policy.
